Your benefit will usually start the Monday after we receive your application. In some circumstances, we may be able to pay Housing Benefit for an earlier date than the date of your claim form. Backdating is sometimes possible, but there are only limited circumstances, so it is best to make your claim for housing benefit as soon as possible. The rules about when we can pay a backdate are different for people who are working age and people who have reached pension age.If you (or your partner if you have one) have reached pension age, you don’t have to ask us to backdate your claim – we will automatically check if we can when we receive your form.As a result, some of the elements on this page may not behave as you might expect. If your claim for Housing Benefit is successful we usually pay you benefit from the Monday after the day we receive your claim. Box 2015 Pershore WR10 9BG Email: [email protected] Tel: 020 8359 2000 Type Talk: 180 2000 Tell us what date you want the benefit to start from and why you didn't claim earlier. If it wasn’t something in Reg 26(3) they won’t get the backdate. They were told after 3 weeks to ring new style ESA. If this client satisfies the contribution conditions he should get ESA(c) from day 1, supplemented by UC from week 3 onwards, and if he has been talked into formally withdrawing the ESA claim by DWP he should complain and receive compensation equal to the amount lost plus something for time and trouble. But the ESA claim should still be processed anyway, so at least they will have that for the first three weeks (and a continuing award of ESA alongside UC, which has some advantages and is not a complete waste of time). When they rang they said to them that they cant get UC and new style ESA at the same time! So you don’t think that I can argue the health problems stopping him fully understanding the claims process to be able to claim the correct benefit at the right time or is that clutching at straws? If there is still an undecided ESA claim hanging in limbo it should be decided. Cut the backdate from 3 mths to one month then give limited reasons for backdating.
A claim for housing benefit for a claimant of working age can be backdated for a maximum of one month.A working age claimant must have a good cause (see below) for her/his late claim throughout the period for which backdating is requested.
